5. Payments and Subscriptions

• Payments: For monthly or quarterly subscriptions, payment will be charged at the beginning of each billing period.

• Automatic Renewal: Subscriptions will automatically renew every 30/90 days, and the user will be charged according to the selected plan. If you do not wish to renew automatically, you must notify us before the renewal date.

• Refund Policy: We do not offer refunds for payments made, except in cases where the service has been interrupted due to unresolved technical issues within a reasonable timeframe.

6. User Rights and Obligations

• Users agree not to use the service for illegal, abusive, or harmful activities.

• The use of the AI calling system for spam calls or to collect data without the express consent of recipients is prohibited.

• It is prohibited to use the application to infringe on the rights of others, distribute malicious software, gain unauthorized access to our systems, or disrupt the experience of other users.

• Users are responsible for managing and protecting their customer data.

• In accordance with EU consumer protection legislation, users have the right to withdraw from the contract within 14 days of starting to use the services, without having to justify their decision. After this period, users will no longer benefit from the right of return.

7. Limitation of Liability

Aisyum shall not be liable for indirect damages, loss of data, loss of profits, or any other type of damages that may result from the use or inability to use the services. In the event of an issue related to the services provided, our liability will be limited to refunding the value corresponding to the period during which we did not fulfill our obligations. In case the service is temporarily unavailable due to technical reasons, maintenance, or any other reason beyond Aisyum's control, we will not be liable for any resulting losses or damages. Our service may contain links to third-party websites or services that are not owned or controlled by Aisyum. Aisyum has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. We do not guarantee the offers of these entities/individuals or their websites.

8. Intellectual Property

• Copyrights: All materials and technologies provided by Aisyum, including the AI software, are protected by copyright and other intellectual property rights.

• License to Use: We grant you a non-exclusive and non-transferable license to use our services in accordance with these terms. You do not have the right to distribute our AI system.

10. Termination of the Agreement

• By the User: Users may terminate their account at any time by sending a cancellation request to our support team; however, we will not refund any payment for the current month.

• By Aisyum: Aisyum may terminate access to services if the user violates the terms of this agreement or engages in illegal activities.

11. Force Majeure

Neither Aisyum nor the users will be held responsible for the failure to fulfill any obligation under these Terms and Conditions if such failure is caused by force majeure events, as defined by the applicable laws in Romania and the European Union. Force majeure includes, but is not limited to, natural disasters, pandemics, wars, major cyberattacks, or any other circumstances beyond our reasonable control.

12. General Provisions

• If any provision of these Terms is deemed illegal or unenforceable, that provision will be considered separate, and the remaining terms will remain valid.

13. AI Hallucinations and Reliability of Information

Please be aware that our AI system may occasionally produce results that could be considered "hallucinations" or inaccurate information. These situations may arise from the limitations of the AI training data or the inherent biases of the system. While we strive to provide accurate and reliable content, our AI's knowledge is based on information available up until the end of 2021 and may not have the most recent updates on certain topics. As a user, you are responsible for verifying the accuracy and reliability of the information provided by our AI system.
